1. Who you are dealing with

This site is owned and operated by Here for the Women's Race SA (Pty) Ltd, a private company registered in South Africa. We are a for-profit social enterprise: we sell apparel and run events, and we commit 100% of net profit to grants for female endurance athletes. Purchases are commercial transactions with the company. They are not donations, and they are not tax deductible.

Our full particulars, as required by section 43 of the Electronic Communications and Transactions Act 25 of 2002, are set out under Business contact details at the foot of this page.

2. Accepting these terms

By using this site, placing an order, entering an event or submitting an application, you agree to these terms. If you do not agree, do not use the site. We may change these terms; the version published here when you place an order is the version that governs that order, and the review date at the top tells you when it last changed.

3. Prices and payment

• Currency. Every price on this site is in South African Rand (ZAR) and includes value-added tax where it applies. The company is not yet registered for VAT; no VAT is charged and no tax invoice is issued.
• What the price covers. The price shown on a product page is for that item only. Delivery is charged separately and is shown in the cart and again at checkout before you pay. Nothing else is added afterwards: the total on the checkout page is the amount we ask your payment provider to take.
• Delivery cost. A flat R95 per order anywhere in South Africa, free on orders of R900 or more. See the shipping and delivery policy.
• Contribution. Part of the price of each item goes to the athlete grant pool. It is part of the price, not an extra charge.
• Payment. Payments are processed by PayFast (Payfast (Pty) Ltd) on their secure pages. We never see or store your card details. Your order is confirmed only once the payment provider confirms the payment to us.
• Errors. If a price or product description is obviously wrong, we may cancel the order and refund you in full rather than supply at the incorrect price. We will tell you before doing so.

4. Orders and stock

An order is an offer to buy. We accept it when we confirm payment by email. Stock is limited to what a drop produced, so an item can sell out between your adding it to the cart and paying. If we cannot supply something you paid for, we cancel that line and refund it in full under the refund policy.

5. Returns, refunds and cancellations

Your rights to return goods, to cancel, and to be refunded are set out in full in the refund policy and the cancellation policy. Those policies form part of these terms and do not limit your rights under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act.

6. Event entries

Entering an event is a purchase of a place at that event, subject to the organiser's rules as well as these terms. Entries are personal to you. Event cancellation, postponement and transfer are dealt with in the cancellation policy. Endurance sport carries risk; you enter on the basis that you are medically fit to participate and that you accept the ordinary risks of the discipline.

7. Grants, PBO and partner programmes

Grant applications are assessed at our discretion against the eligibility rules published on the athletes page. Applying does not create an entitlement to funding. Grants are paid against receipts or directly to providers, and funded applicants agree to report on the use of funds within 60 days of the target event. We may publish anonymised or, with consent, named outcomes on this site.

8. Section 18A and tax

We do not issue Section 18A receipts. Philanthropic donations seeking a Section 18A deduction are made to verified partner public benefit organisations, which issue the receipts and disburse funds under a written memorandum of understanding. Nothing on this site is tax advice.

9. Our profit commitment

We commit 100% of net profit from merchandise and events to the athlete grant pool, . Figures are reviewed annually by an independent accountant.

10. Intellectual property

Here for the Women's Race® is a registered trade mark of Here for the Women's Race SA (Pty) Ltd in South Africa. The site's text, images, code and design belong to us or our licensors. Wear the shirt, share the sentence, hand out the stickers. Do not reproduce the mark on goods for sale, or copy the site's content for commercial use, without our written permission.

11. Your account of yourself

Information you give us in an order, an application or a form must be true and complete. We may decline or reverse a transaction, or withdraw a grant, where information is materially false.

12. Availability of the site

We aim to keep the site available, but we do not promise it will be uninterrupted or error free. We may suspend it for maintenance or change it without notice.

13. Liability

Nothing in these terms limits liability that cannot lawfully be limited, including under the Consumer Protection Act. Subject to that, we are not liable for indirect or consequential loss, and our liability arising from an order is limited to the amount you paid for it.

14. Privacy

How we handle personal information is set out in the privacy policy, which complies with the Protection of Personal Information Act 4 of 2013.

15. Complaints and disputes

Tell us first: email info@hereforthewomensrace.org.za and we will reply within two working days. If we cannot resolve it, you may refer the matter to the National Consumer Commission or to a recognised alternative dispute resolution agent. These terms are governed by South African law, and the South African courts have jurisdiction.
